Article 1 - Purpose
These terms and conditions govern the sale of products by SUPER DIET Laboratories - 185 boulevard de la Liberté 59800 LILLE - to persons browsing the www.superdiet.com website
Article 2 - Prices
The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the date of the order), unless otherwise indicated, and exclusive of processing and shipping costs.
All orders, whatever their origin, are payable in euros.
SUPER DIET Laboratories reserve the right to modify their prices at any time, but the product will be invoiced on the basis of the price list in effect at the time the order is validated and subject to availability.
Products remain the property of Laboratoires SUPER DIET until full payment has been received.
Caution : As soon as you (or a third party designated by you) take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you
Article 3 - Orders

Contractual information is presented in French and will be confirmed at the latest upon validation of your order.
SUPER DIET Laboratories reserve the right not to register a payment, and not to confirm an order in the event of a dispute with the customer (particularly in the event of unpaid invoices)
Article 4 - Validating your order
All orders placed on the www.superdiet.com website imply full acceptance of these terms and conditions of sale, without exception or reservation.
All data supplied and the recorded confirmation shall constitute proof of the transaction.
Confirmation of the order will constitute signature and acceptance of the operations carried out.
A summary of the information contained in your order and the present General Conditions will be sent to you via the e-mail address used to confirm your order
Article 5 - Payment
The fact of validating your order implies for you the obligation to pay the indicated price.
Payment is made by credit card using the Axepta secure system.
The card is debited at the time of payment. In the case of split deliveries, only products shipped are debited.
Orders over 600 (incl. VAT) will not be delivered until payment has been received
Article 6 - Withdrawal
In accordance with the provisions of article L.222-7 of the French Consumer Code, you have a period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay any penalty.
Products must be returned in their original condition and complete (packaging, accessories, instructions), so that the product can be resold. Any damage to the product may be grounds for refusal of the right of withdrawal. If you wish to return a product in order to exercise your right of retraction, you must send a request by e-mail (infoproduits@superdiet.fr) or by post to Service consommateurs - BP70010 - 59721 DENAIN Cedex, enclosing the retraction form available
here, duly completed, within 14 days of the delivery date.
You are responsible for return shipping costs.
In the event of exercising the right of retraction, LABORATOIRES SUPER DIET will reimburse the sums paid, within 14 days of notification of your request and using the same means of payment as that used for the order
Article 7 - Availability
Our products are offered as long as they are visible on the www.superdiet.com website and while stocks last.
If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made.
Moreover, the website www.superdiet.com is not intended to sell its products in large quantities. Consequently, SUPER DIET Laboratories reserve the right to refuse orders of 10 identical items
Article 8 - Delivery
Products are delivered to the delivery address indicated during the order process, either at home or at a relay point, within the time indicated on the order validation page.
For home deliveries, a signature will be required to confirm receipt of the parcel. In the event of absence, the parcel will be dropped off at the nearest relay point.
Products are delivered in metropolitan France.
Delivery times may be extended due to the condition of delivery on receipt of funds for orders over 600 including VAT.
In the event of late shipment, an email will be sent to you by the carrier.
In accordance with legal provisions, in the event of late delivery, you have the option of cancelling the order under the terms and conditions defined in article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will proceed to reimburse you and the shipping costs according to the conditions of article L 138-3 of the French Consumer Code.
SUPER DIET Laboratories cannot be held responsible for late delivery due exclusively to the customer's unavailability after several proposed appointments
Returns with the reason «RTS»:
Returns marked «RTS» correspond to packages returned by the delivery service provider with the mention : «Return to Sender» («Does not reside at the address indicated»). After reception and acceptance of the returned parcel by Laboratoires SUPER DIET, a credit note for the total amount of the order, shipping fees deducted, will be credited to the Client's account within forty-eight (48) hours following the reception of the parcel by Laboratoires SUPER DIET. The Customer will then be able to place his order again, making sure the delivery address is correct
Unclaimed returns:
Unclaimed returns correspond to parcels that have not been claimed by customers at the relay points within fifteen (15) days of the delivery notice. After reception and acceptance of the returned parcel by Laboratoires SUPER DIET, the customer may be credited for the amount of his order, shipping fees deducted, or he may choose to return his order and pay the shipping fees corresponding to this return
Article 9 - Warranty
In the event of non-conformity or defect of the products delivered, you must send a complaint by e-mail (infoproduits@superdiet.fr), or by post to Service consommateurs - BP70010 - 59721 DENAIN Cedex.
9.1 Legal warranties
« It is recalled that the consumer, in the context of the legal warranty of conformity:
- benefits from a period of two years from delivery of the goods to take action
- may choose between repair or replacement of the goods, subject to the cost conditions set out in article L. 217-9 of the French Consumer Code
- is exempted from proving the existence of a lack of conformity
The legal guarantee of conformity provided for in articles L. 217-4 to L. 217-12 of the French Consumer Code applies independently of the guarantee relating to defects in the item sold, under the conditions set out in articles 1641 to 1648 and 2232 of the French Civil Code.«
Article L217-4 of the French Consumer Code:
«The seller is required to deliver goods in conformity with the contract, and is responsible for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was made his responsibility by the contract or was carried out under his responsibility.»
Article L217-5 of the French Consumer Code:
«To be in conformity with the contract, the goods must:
1) Be fit for the use normally expected of similar goods and, where applicable :
- Correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model
- Present the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling
2) Or present the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the attention of the seller and accepted by the latter.»
Article L217-12 du Code de la Consommation :
« L'action résultant du défaut de conformité se prescrit par 2 ans à compter de la délivrance du bien.»
Article L217-16 du Code de la Consommation :
«When the buyer asks the seller, during the course of the commercial guarantee which was granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the guarantee, any period of immobilization of at least seven days, comes to be added to the duration of the guarantee which remained to run. This period runs from the date of the purchaser's request for intervention, or from the date the goods in question are made available for repair, if the goods are made available after the request for intervention.»
Article 1641 of the French Civil Code:
«The seller is liable for any hidden defects in the item sold, which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he been aware of them.«
Article 1648 paragraph 1 of the French Civil Code :
« L'action résultant des vices rédhibitoires doit être intentée par l'acheteur dans un délai de 2 ans à compter de la découverte du vice.»
9.2 Contractual warranty in case of lack of conformity
In the event of product non-conformity, notified within 30 days of delivery, you may request a refund.
After 30 days, only a replacement (or a repair if the product allows it) under the legal guarantee of conformity can be granted
Article 10 - Liability
The products offered comply with current French legislation. Laboratoires SUPER DIET cannot be held responsible in case of non-respect of the legislation of the country where the product is delivered if the delivery is made outside France. It is your responsibility to check with the local authorities about the possibility of importing or using the products or services you plan to order.
Laboratoires SUPER DIET cannot be held responsible for damages resulting from improper use of the product purchased.
Finally, Laboratoires SUPER DIET cannot be held responsible for any inconvenience or damage inherent to the use of the Internet network, notably a break in service, external intrusion or the presence of computer viruses
Article 11 - Applicable law in the event of disputes
The language of this contract is French. The present conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction
Article 12 - Intellectual property
All elements of the SUPERDIET website are and remain the exclusive intellectual property of Laboratoires SUPER DIET. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, be they software, visual or audio. Any simple or hypertext link is strictly forbidden without the express written consent of Laboratoires SUPER DIET
Article 13 - Archiving - Evidence
Laboratoires SUPER DIET will file order forms and invoices on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1379 of the French Civil Code.
The computerized registers of Laboratoires SUPER DIET will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties
Article 14 - Mediation of consumer disputes
In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, Laboratoires SUPER DIET is a member of the Association of European Mediators (electronic commerce) whose contact details are as follows: Médiation de la consommation AME, 11 Place Dauphine, 75001 Paris, www.mediationconso-ame.com.
You can use the mediation service for consumer disputes related to an order placed with Laboratoires SUPER DIET on the Internet. In accordance with the rules applicable to mediation, any consumer dispute must be submitted in advance in writing to SUPERDIET's Consumer Service : BP70010 - 59721 DENAIN Cedex.
After prior written request from the consumer to Laboratoires SUPER DIET, the mediator may be contacted for any unsuccessful consumer dispute.
